Although not officially advertised for objections, the Timber Yard developer’s latest application is now available for viewing.

It seems he is failing to listen to VCAT and residents, and has submitted fundamentally-the-same application again. He has completely missed the opportunity to submit a different proposal that will integrate into our neighbourhood (and it’s character) without dominating it.

 

Resident consultation farce.

The developer is requesting Council to… “conduct a consultative meeting with residents as discussed which could be in the form of an information evening either prior to, during, or after the formal advertising period.”

Council are considering the developer’s request.

It is clear by the developer’s indifference of the timing of any consultative meeting, he is not really interested in in incorporating residents’ feedback into his design.

Why Déjà vu? The previous two consultative efforts resulted in the developer suspending meetings, not incorporating resident feedback and submitting his plans anyway.

 

What’s the new design like?

Summary:

  • Still a massive dominating development, incongruous with the neighbourhood and neighbourhood character.
  • 43 dwellings (8 x 1BR, 32 x 2BR, 3 x 3BR) in a single building mass occupying the majority of the site. Dwelling density increased by an additional unit since the last application.
  • Predominately three stories around the perimeter with some two stories on corners. Fourth story central tower comprising rooftop private open space and enclosed (ugly) stairwells.
  • Dominating third level cantilevered forward. Pitched roofs added, but framed and blocky facade. Predominately concrete construction with brick and masonry cladding.
  • Many units overlooking Armstrong Reserve and children’s playground. Absolute minimal private open space for residents. Resident car parking via car stacker systems.

Why Déjà vu? There has been no attempt to reduce the dominance, density, and incongruous design.

What happens now?

We wait to see what Council will do with the developer’s request; and for the advertising period to start so residents can object as necessary.

After a meeting with the timber yard developer, we were expecting a response about ideas put forward on behalf of residents to resolve current issues. This was expected to happen prior to the developer making the permit application to Council.

The developer has decided to make the planning application to Council first, then undertake Council and community consultation process.

The developer contacted an objector representative to discussion the issues of the Timber Yard development and try to come up with a design that may be acceptable to the community, Council and VCAT.

Progress update:

  1. Representatives for objectors had discussions with the developer where issues with the previously rejected design were considered. Amongst other things, examples of more acceptable developments and styles were presented to the developer.
  2. The developer came back with draft amended design, which although had some improvements with gaps and roof lines, did not satisfy residents primary concerns of bulk, height, form and materials.
  3. A further meeting took place where the improvements and failings were discussed and residents proposed a design that (as a minimum) may be more acceptable to the community.
  4. The developer is considering this and will come back to us shortly.
  5. If a suitably responsive re-design is returned by the developer, this will be the subject of a residents meeting; to review the proposal and provide a public acceptance position back to the developer.

Hopefully this process will result in a re-design that deals with community, Council and VCAT concerns; and enables the site to be developed in a way acceptable to all parties.

Last weekends sausage sizzle to celebrate our VCAT win was great – and a good chance to catch up socially with neighbours before the silly season is upon us.

A big thank you to everyone who brought along a donation, we hit our target and have now covered our fighting fund shortfall… all bills are paid in full.

We have just received the decision – VCAT have upheld the Council’s decision to not grant a permit to the applicant.

Conclusion

1. The review site provides a good opportunity to introduce a more intense and diverse form of housing into the location.  Given its attributes, the use of the land is appropriate.  However, for the above reasons, we find that in this location, the design fails to respond acceptably to the built form of the heritage protected neighbourhood and we do not consider that the amendments made to the previous proposal are an acceptable response to the previous Tribunal decision.

2. For these reasons, the decision of the Responsible Authority is affirmed.  No permit is granted.

Hi everyone,

While we wait for a decision from VCAT the fighting team is calculating the expenses of external professionals that were required. Some of these included the town planner and videographer, each of which gave us very good rates and excellent value for the communities money.

Previous fund raising activities and donations have helped cover a lot of these costs, but we have a funding shortfall of $1300 and are looking for further assistance to cover these final bills.

After four days of submissions, expert witnesses, cross examinations, and conditions submissions; the hearing has concluded.

Council spent around a day presenting their expert witnesses, and being cross examined by the developer and residents.

A site visit was held on Tuesday morning. Residents representatives spend the rest of Tuesday providing their submission which included slides, DVD, and documents.

The developer’s lawyer spent two day presenting their expert witnesses, and being cross examined by the Council and residents representatives.

Thursday concluded with Council and residents submitting conditions (potentially applicable if the permit is approved), and the developer opposing these requirements where possible.

 

Melissa, Darren, Alison and Anthony spend the entire duration performing the cross examinations, providing submissions and conditions on behalf of resident objectors.

A few residents dropped in to observe and provide them support.

 

The VCAT members presiding over the hearing were courteous and provided us with sufficient time for detailed cross examination and provide our submissions in full.

 

A decision by the VCAT members was not made today and is not expected tomorrow, but will take the members more time to consider. It will not take longer than four weeks as per Major Case List procedure.

Today saw the representatives for the objecting residents delivery their submission… which included a slide presentation of many issues; and a DVD highlighting key features of our neighbourhood, residents reactions, how the development will look if built, and how we will feel the impact.

The VCAT tribunal members also conducted an accompanied site inspection this morning. With us, Council and the developer’s representative present.

Tonight we are busily finalising our written submission to be delivered tomorrow morning.

Tomorrow will see the developer’s expert witnesses give their evidence. Council and the resident representatives will cross examine these experts. This is likely to continue through to the end of Thursday.

The VCAT hearing on the Timber Yard development starts tomorrow. The develop is hoping to overturn the Councils permit refusal decision.

 

Schedule:

Council will present their case tomorrow. Calling two expert witnesses.

Representatives on behalf of residents will likely present their case Tuesday.

The developer will likely present their case Wednesday, Thursday, Friday.  Calling six expert witnesses.

The Timber Yard development goes to VCAT  in less than two weeks.
The developer and Council have submitted their expert witness reports prepared for the hearing.

The resident objectors team are reviewing the reports and finalising their submission which will be given to VCAT during the hearing.
